What workplace system am I covered by?

State Industrial Relations System

The South Australian public sector (including almost all Government Business Enterprises) and the South Australian local government sector are subject to the State Fair Work Act 1994 and are part of the state industrial relations (IR) system. See the list of local government and Government Business Enterprises (PDF 82kb) remaining in the state IR system. Employers and employees in these sectors should contact the SafeWork SA Help Centre on 1300 365 255 for further information.

National Industrial Relations System

All South Australian private sector businesses (including the non-government community services sector, private schools and universities) are covered by the Commonwealth Fair Work Act 2009 and are part of the national IR system.

Two Government Business Enterprises - SA Water and TransAdelaide, are also subject to the Commonwealth  Fair Work Act 2009 and part of the national IR system.

NOTE: There are a number of state laws that continue to apply to employers and employees in the private sector even though they are covered by the national IR system.
