SafeWork SA (the Regulator) may exempt a person or a class of persons from compliance with any of the Work Health and Safety Regulations pursuant to Regulation 684 of the Work Health and Safety Regulations 2012 (SA).

181(3) - Use of Dive Safety Log

Exemption details

A PCBU who is a holder of an abalone fishery licence issued under the Fisheries Management Act 2007 and the Fisheries Management (Abalone Fisheries) Regulations 2006 is exempt from complying with Regulation 181(3).

Conditions imposed upon exemption

The return of each diver is verified in the dive safety log, as soon as practicable after the return, by the diver and the diver supervisor, as required by Regulation 181(2).

243 - Plant design to be registered

Exemption details

Specified miniature boilers to be exempt from the design registration requirement.

Conditions imposed upon exemption

That the boilers be designed, verified and manufactured in accordance with the relevant AMBSC Codes.

Exemption details

A person that holds a registration document issued by the regulator pursuant to Regulation 261 of the Work Health and Safety Regulations 2012 (SA) and Regulation 274 of the Work Health and Safety Regulations 2012 (SA) who seeks a replacement registration document in electronic format from the Regulator is not required to pay the prescribed fee for the replacement document as required by Regulation 288(4)(b).

Conditions imposed upon exemption

This exemption is subject to all other duties and requirements of the Work Health and Safety Act 2012 (SA) and the Work Health and Safety Regulations 2012 (SA) being complied with.

316, 317 and 326(1) - General Construction Induction Training

Exemption details

Exemption from the requirements for the District Council of Streaky Bay to provide general construction induction training to a worker engaged by the PCBU to carry out construction work, to ensure a worker has been trained in general construction, and for a construction worker to have available their training card for inspection.

Conditions imposed upon exemption

  • Exemption applies only to volunteers assisting on the Streaky Bay Oval Precinct Development.
  • All volunteers must be inducted onto the worksite and made aware of the hazards associated with the site and any specific task before commencing work.
  • At all times, the volunteers must be under the supervision of a competent supervisor who holds the construction industry White Card.
  • Volunteers shall not carry out any form of high risk construction work as defined in Regulation 291.
  • Volunteers shall not operate mobile construction plant including loading and unloading plant and equipment.
  • Volunteers shall not work in or adjacent to an excavation greater than 1.5 metres deep.
  • Volunteers shall not carry out any licensed trade activity such as plumbing or electrical work.
  • All work must be carried out in compliance with:
    • the Work Health and Safety Act 2012 (SA) and the Work Health and Safety Regulations 2012 (SA); and
    • the District Council of Streaky Bay's policies and procedures relating to work health and safety.

Exemption details

A mine operator of a mine employing less than five workers is not required to are not required to give the regulator a quarterly work health and safety report in accordance with Regulation 675W of the Work Health and Safety Regulations 2012 (SA).

This exemption is subject to all other duties and requirements of the Work Health and Safety Act 2012 (SA) and the Work Health and Safety Regulations 2012 (SA) being complied with.

Exemption details

SA oyster farmers undertaking general diving work to produce video transects of the ocean floor in relation to the sub-tidal leases in order to meet licence conditions required by PIRSA are exempt from complying with the diving provisions.

Conditions imposed upon exemption

  • The dive must be for the purpose of producing underwater video transects of the ocean floor in order to meet licence conditions required by PIRSA.
  • The diver can demonstrate evidence of holding a relevant diving qualification.
  • There is always an observer present in the boat.
  • The dive lasts no longer than 30 minutes.
