SafeWork SA Inspectors will use Body Worn Cameras (BWC) as part of their operational equipment from 4 September 2023.

The BWC is a recording device that enables the recording of audio and video footage.

Inspectors will have access to BWC to use during worksite visits or while undertaking compliance and investigation activities.

The use of BWC are intended to:

  • support the safety of Inspectors by encouraging safe and mutually respectful interactions
  • reduce disputes and enable complaints to be easily investigated and resolved by reviewing relevant footage
  • support transparency and accountability for Inspectors while administering their duties and exercising their powers.

The footage captured by the BWC will assist our inspectors with their enquiries and investigations involving workplace incidents.

When will inspectors use BWC?

Inspectors will use BWC in the following circumstances:

  • when responding to a critical event such as a fatality, serious injury or dangerous incident
  • when responding to matters where there is an immediate or imminent risk to health and safety
  • where an inspector has been appointed to resolve a dispute in relation to a work health and safety entry permit holder matter
  • where it has been identified that a client may be aggressive, or where sufficient or a lack of information available to SafeWork SA suggests the same

Inspectors may use BWC in other circumstances, including:

  • routine compliance activities
  • proactive compliance campaigns
  • when an Inspector has determined there is a reasonable need to use a BWC when attending a workplace

How will inspectors use BWC?

Inspectors will wear BWC on the front of their uniform, so they are clearly visible. The BWC will remain visible at all times during any interaction with persons.

When activating the BWC, Inspectors will consider a number of factors such as:

  • environments where the BWC is to be used, including security sensitive environments where classified material is present or where classified operations are being undertaken
  • involvement of vulnerable people
  • any other existing relevant factors.

When activating the BWC, Inspectors will consider whether its use is appropriate having regard to the physical environment, for example:

  • is the environment a security sensitive environment where classified material is present or classified operations are being undertaken
  • the presence or involvement of vulnerable people at a particular site, and
  • any other factors deemed relevant by the inspector in attendance.

Inspectors will clearly advise the person(s) being recorded of the presence of the BWC and that it will be recording video and audio of their actions and conversations.

Operating a BWC

All inspectors and investigators have undertaken the required training to operate BWC.

What if I don’t want to be recorded?

Inspectors will note and record your objection to being recorded, however inspectors can continue to record the interaction as they undertake their activities and exercise their powers under relevant Acts.

Inspectors will not make recordings of private activities in the workplace.

Where will the information collected from BWC be stored?

The recordings captured by the BWC are stored in a secure evidence management system with controlled access.

The recordings will be managed in compliance with relevant legislation including the State Records Act 1997.

How will I access BWC records?

Footage will not be shared with external parties unless required by law.

Freedom of Information (FOI) provides members of the public a general right to make requests to access government information in accordance with the Freedom of Information Act 1997.

All requests for access to BWC recordings under FOI must be directed to SafeWork SA.
